Terms of service

The rules that govern using Studmark and the kits you buy from the storefront — license, refunds, updates, intellectual property, and the small but important standard disclaimers.

A note about this draft

This page is the starter copy for Studmark's terms of service — written for how the storefront actually operates today, but intended to be reviewed by counsel before launch. The license and refund paragraphs cross-reference Help & FAQ, so the buyer-facing language can be kept current in one place.

Using the storefront means agreeing to these terms
Acceptance

These terms form an agreement between you and Studmark(“we”, “us”, or “our”). By visiting the storefront, creating an account, or buying a kit, you agree to them.

If you do not agree, please do not use the storefront. You can still read the marketing pages, the catalog, and the blog without accepting these terms — acceptance only kicks in when you create an account or check out.

What we sell and how it is delivered
The service

Studmark is a curated storefront of digital study kits. Each kit is a coordinated three-part bundle:

  • A Notion template. A live, editable system (planner, dashboard, roster, or workbook) delivered as a duplicate-to-your-workspace link.
  • A printable .xlsx spreadsheet. The companion grade book, plan book, or roster sheet.
  • A printable .pdf workbook. The worksheets and assignment prompts, ready to print.

Kits are downloadable digital products delivered immediately after the purchase clears. No physical item ships, and we do not manufacture, warehouse, or carry inventory.

Your account and your credentials
Accounts

Buying a kit does not strictly require an account — order emails and downloadable files can go straight to the inbox at checkout. If you do create an account, you are responsible for keeping your password safe and for activity on your account. Tell us promptly if you suspect an account has been compromised.

What you can (and cannot) do with a kit
License

A Studmark kit is sold as a one-time purchase for one teacher (or one self-directed learner). With that purchase, you may:

  • Use the kit with the students you teach or with your own self-directed study. No per-student fee, no seat count, no subscription renewal.
  • Edit and adapt the templates freely to fit your subject, grade, or week.
  • Print the workbook and spreadsheets for the classroom or study group.

You may not, without explicit written consent:

  • Resell the source files, whether as-is or as part of a larger bundle.
  • Redistribute the kit publicly (for example, by posting the duplicate link or the .pdf workbook as a free download).
  • Republish the kit on another marketplace, on your own storefront, or in a kit-of-kits product you sell.

The full, plain-language version of this license lives on the Help & FAQ page, where it can be updated without touching this draft.

Refunds and exchanges
Refunds

Because kits are digital downloads delivered immediately, they are non-refundable once the files have been delivered.

If a kit does not match its listing (wrong contents, a broken file, a missing format we advertised), we will replace the kit or refund the purchase in full, at your choice, within 14 days of delivery.

The full version of this policy (including how to send a refund or replacement request) lives on the Help & FAQ page.

The single source of truth for this policy is the FAQ on refunds; if this page ever disagrees with that FAQ, the FAQ wins.

Updates to a kit you already bought
Updates

Every purchase comes with free lifetime updates. When we ship a new version of a kit (a refreshed dashboard, a new worksheet, a typo fix), we re-send the updated files to the order email. You do not have to do anything to keep receiving them.

We may retire a kit — for example, if a third-party service it depends on no longer exists — but the files you have already received stay usable, and we will offer a replacement or refund where applicable.

Who owns what
Intellectual property

The storefront, the brand name, the marketing copy, the catalog layout, and the originals of every kit with their worksheets and dashboards are owned by Studmark(or licensed to us by the kit creator). Buying a kit gives you the license described above; it does not transfer ownership.

If you contribute a piece of content to a kit you later write or assemble with us (for example, a teacher-submitted lesson plan), you grant Studmark a non-exclusive license to publish and refine that contribution as part of the kit. You can withdraw a contribution by emailing us, but it may not be possible to strip it out of already-distributed Notion duplicates.

The rules of the road
Acceptable use

When using the storefront or the kit files, please do not:

  • Probe, scan, or test the vulnerability of the storefront infrastructure.
  • Scrape the catalog or the kit previews in a way that bypasses our rate limits.
  • Reverse engineer, decompile, or otherwise attempt to extract the source model of a paid kit in order to skip the purchase.
  • Use the storefront or its content to harass, defame, or impersonate anyone.
A standard (and important) disclaimer
Disclaimers

The kits are educational and productivity tools. They are provided on an as-is basis. While we design and test them with care, we cannot guarantee that a particular kit will meet the requirements of a specific curriculum, a particular grade, or a particular student outcome.

Where the law in your jurisdiction allows, Studmark is not liable for indirect, incidental, or consequential damages arising from the use of a kit, to the maximum extent permitted by law.

Which set of laws applies
Governing law

These terms are governed by the laws of the jurisdiction in which Studmark is incorporated. If a dispute arises that we cannot resolve by email, the courts of that jurisdiction will hear it. (The founder sets this to the home country / state of incorporation before launch.)

If these terms change
Changes

When we change these terms, we update the “Last updated” date at the top and, for a clearly material change, send a note to active account holders before the change takes effect. Continued use of the storefront after a change takes effect means you accept the new terms.
